Terms and Conditions
1. Introduction
These Terms and Conditions (“Terms”) govern the use of services and products provided by SimplySHEQ (“Company”, “we”, “our”, “us”). By engaging with SimplySHEQ for health and safety services, Personal Protective Equipment (PPE), workwear, promotional items, or branded displays (“Services” or “Products”), you (“Client”, “you”) agree to be bound by these Terms.
2. Scope of Services
SimplySHEQ provides comprehensive services and products in the occupational health and safety sector, including but not limited to:
Monthly Health and Safety Support – Virtual or on-site assistance for implementing and maintaining your Health and Safety Management System, including risk assessment reviews, consulting, and reporting.
Health and Safety Compliance Audits – Audits tailored to company size, providing formal audit reports, action reports, and guidance to ensure legislative compliance.
Mandatory Health and Safety Appointment Letters – Formal letters for various roles including Chief Executive Officer, Health and Safety Representatives, First Aiders, Fire Fighters, Machinery Supervisors, and other legally required positions.
Safety Files – Contractor Health and Safety Files and Administration Safety Files customized to client requirements, consolidating all relevant health and safety documentation.
Health and Safety Inspections – On-site inspections covering building, construction, emergency equipment, hazardous substances, lifting equipment, PPE, vehicles, machinery, and general workplace safety.
ISO Policy Creation – Development of ISO 9001, ISO 14001, and ISO 45001 policies.
Health and Safety Policy Creation – Formal policies including general health and safety, alcohol abuse, smoking, and contractor management policies.
Risk Assessments and Job Safety Observations – Baseline risk assessments, hazard identification, job safety observations, and reporting.
General Consultancy – On-site or virtual consultations for health and safety advice.
Additionally, SimplySHEQ supplies PPE, workwear, promotional items, and branded displays customized to client needs.
3. Client Obligations
Clients must provide accurate and complete information relevant to services, including site details, company information, proposed audit or observation dates, and required documents.
Clients must ensure timely access to premises, personnel, and documentation for inspections, audits, or consultations.
Clients are responsible for maintaining and acting on the recommendations and documentation provided by SimplySHEQ.
4. Product and Service Delivery
Delivery timelines for services and products depend on service type, complexity, and consultant availability.
Custom products (e.g., PPE, workwear, promotional items, and safety files) are produced according to the client’s specifications, including logos and company details.
SimplySHEQ will use reasonable efforts to meet agreed delivery schedules but will not be liable for delays outside its control.
5. Use of Materials and Reports
All materials, policies, reports, safety files, and templates provided remain the intellectual property of SimplySHEQ unless explicitly transferred in writing.
Materials are intended for use by the client for its internal operations and must not be copied, distributed, or resold without prior consent.
Compliance with health and safety legislation remains the responsibility of the client.
6. Liability
SimplySHEQ provides services and products to the best of its professional ability. However, the Company is not liable for any direct or indirect loss, injury, or damage resulting from the client’s failure to implement recommendations or comply with relevant legislation.
Liability is limited to the cost of the service or product provided.
7. Amendments and Updates
SimplySHEQ reserves the right to update these Terms at any time. Clients will be notified of changes via email or other communication channels.
8. Cancellation and Termination
Service engagements may be canceled or rescheduled with prior notice as agreed between SimplySHEQ and the client.
Once customized products or documents have been prepared, cancellation may not be accepted or may incur a charge to cover incurred costs.
9. Confidentiality
Both parties agree to maintain confidentiality regarding business, personnel, or site information obtained during the provision of services.
This clause survives the termination of services or agreements.
10. Governing Law
These Terms are governed by the laws of South Africa.
Any disputes arising will be resolved through negotiation in good faith, and if necessary, submitted to the appropriate South African courts.
11. Acceptance
By requesting or using SimplySHEQ services or products, the client acknowledges having read, understood, and agreed to these Terms and Conditions.
